Applications for Fire Safety Certificates - New Procedures
From 1st January 2008 Kilkenny County Council (Fire Authority) will amend its procedures regarding the processing of applications for Fire Safety Certificates under the Building Control Regulations 1997. This is to bring the Authority into line with best practice for this procedure.
After this date when an application for a Fire Safety Certificate is lodged with Kilkenny County Council, the applicant will be sent a receipt of documents and fee. The applicant will not be given an application number at this point. The application will then be assessed under Section 13 of the Regulations to ascertain whether or not it is a valid application.
When the application has been assessed for validity if it is found to be a valid application, the applicant shall be sent notification informing them that the application is valid, the date the application was received and giving them an application number. The Authority will then have two months from the date the documents were lodged to complete the assessment of the application and to make a decision whether to grant the application (with or without conditions) or to refuse the application. During this time the Authority
may request further information from the applicant regarding the application.
When the application has been assessed for validity and if it is found to be an invalid application, the Authority will have two options:
1. The Applicant shall be informed that the application is invalid and the complete application including fee will be returned to the applicant; or
2. The Applicant shall be informed that the application is invalid. The Authority will require the Applicant to furnish further information to render the application valid. The application will be held in abeyance until receipt of the required information. When the necessary information has been received to render the application valid the Authority shall proceed as above.
In this case the date of receipt of the application shall be the date the further information was received by the Authority, not the date the original application was received by the Authority.
